General Conditions of Sale
1. Field of application
The General Conditions of Sale apply to all orders placed using Kusmi Tea website www.kusmitea.com
The client acknowledges having taken note of these present General Conditions of Sale and that they accept these terms.
The product range of Kusmi Tea is aimed solely at individual clients and under no circumstances to professional retailers. Kusmi Tea reserves the right to refuse the benefit of access to its product range to any client who may prove to be a professional retailer, and such unilateral cancellations may take place at any time between the date of the order and for the 12 months following their planned delivery.
2. Order processing
Kusmi Tea commits to process orders placed on the Kusmi Tea website following the terms of these present General Conditions of Sale and providing that the product is available in stock.
By confirming your order, you confirm that you accept these present General Conditions of Sale.
Orders will only be processed once payment has been received, which will be confirmed by email.
Kusmi Tea reserves the right to cancel any order that is non-compliant, or suspect, as well as orders from clients with whom there is a dispute of any kind.
The prices indicated on the US website are expressed in dollars. The price displayed includes price of the product, the handling, the package and the storage cost but it doesn’t include any contribution for carriage and for the delivery cost. Tea is not subject to any tax in the US, however, accessories are. The product tax will be notified on the cart “check-out” page.
For US and Canada delivery the cost of delivery depends on destination, weight of products and shipping method. Your shipping cost will appear before validating your purchase.
For delivery outside the US (see countries list on the “delivery and tracking” page). The price indicated in the order confirmation is the final price that you will be charged including the product tax (for accessories only) and the shipping cost.
The site www.kusmitea.com is intended for use by individuals and not by companies. No reimbursement of VAT can be made for an order placed by a company.
4. Product availability
Products are offered within the limitation of time for each instance of sale and subject to the limit of available stocks.
Kusmi Tea cannot be held responsible for any stock shortage that may lead to a delay in delivery of the order.
Orders are only definitive when confirmed by the payment of the corresponding price by the purchaser.
In the case of non-availability of one or more products following confirmation of the order, Kusmi Tea will notify the client by e-mail as soon as possible and offers him a refund for the concerned product(s).
Kusmi Tea delivers to many countries worldwide.
For further details (shipping cost, delivery time frame...) please click here. Delivery cannot be made to countries that do not appear on the list.
The order will be delivered to the shipping address provided by the client.
The client is required to check their package carefully upon delivery to register any damage with the carrier.
The vendor may not and cannot be held liable for the inability to deliver the product owing to errors in entering the name and address of the recipient. Should the product be returned, all handling costs for repeat shipments will be borne by the purchaser.
Payment for products purchased with Kusmi Tea is due in full when the order is placed. Products remain the property of Kusmi Tea until payment is fully received for an order.
Payments can be made by credit card (Amex, Mastercard, Visa) or via Pay Pal.
7. Exchanges and return
Kusmi Tea does not exchange any products.
The customer has 7 days upon reception of his/her package to return a product for reimbursement, without penalty, with the exception of the return cost.
Place the product(s) to return in the original box or equivalent packaging and add the completed Return Form.
Every article received damaged due to a lack of packaging will not be refunded.
Mandatory: Return shipments must be sent via insured ground shipping.
Kusmi Tea will refund your bank account after receiving the returned parcel. Once the products are received, the refunding process takes up to 10 business days.
8. Guarantees against products hidden defects
The vendor is bound by guarantee in respect of hidden defects in the item that render it unfit for its intended use, or which so diminish this use, that the purchaser would not have acquired it, or would have paid only a lower price for it, it they had known of them". The client has up to 2 months following the date of delivery to notify its complaint to Kusmi Tea. Beyond this deadline, the company Kusmi Tea can no longer guarantee the products and the client must prove that the deterioration in quality of the tea pre-dates the date of receipt of the tea.
Claims or disputes will always be treated with due consideration and attention. In case of a dispute, the client should first contact the company in order to seek an amicable resolution firstname.lastname@example.org
Any dispute that cannot be resolved amicably shall be subject to the US jurisdiction.
10. Copyright and intellectual property
All texts and pictures displayed on the website have only the value of information and are in no case contractual.
The creation of a client account requires that the client provides some personal data which are necessary for the processing of an order and for the management of the customer service.
Protection of your personal data
Access to your personal account is protected by a confidential password that you select when you create your Kusmi Tea account.
When you place an order, we require your name, your personal or work address, your email address, and if you have placed an order using a bank card, your card number, the card’s security number(csv) and expiration date. Your personal data are held secured and kept confidential. The information relating to your bank card is not held on our site, and your payment can only be consulted in “encrypted” form by our client service department.
Non-disclosure of information
Kusmi Tea shall never sell, rent, share or otherwise distribute or make available your data to third parties outside of the Orientis group which is the holding of Kusmi Tea, except when required to do so for legal or regulatory purposes.
Right of Access
You have the right to access, update and erased your personal data. You can do so by logging-in into your account and then by clicking on “edit your personal information”.
Most of the information we collect from our website is anonymous information. When you visit our website, we don’t collect any personal Data from you unless specifically, voluntarily and knowingly provided by you. Anonymous information is processed by Kusmi Tea to help improve the content of our website, to customise our website for our visitors and to learn more about them and how they use the website. In doing so, Kusmi tea uses tracking technology (cookies) to gather anonymous information such as browser type, address of the computer you are using, the date and time of your navigation on our site, URLs from which you accessed our site...
A “cookie” by itself cannot be used to discover the identity of the user. We delete this information after a given time. Your computer is probably set up to accept cookies. However, you can modify this configuration. If you do not wish us to collect this type of information, do not navigate to our site.

As a service to our visitors, our website may provide hyperlinks to other websites that are not operated or controlled by Kusmi Tea nor its holding, Orientis. Therefore, neither Kusmi Tea nor Orientis can be responsible or liable for the content of such websites or the privacy practices of such other parties. Please note that these privacy practices may differ from our Policy. We encourage you to review and understand their privacy practises before providing them with personal information.
11. General terms and conditions of membership to the "KusmiKlub" loyalty program
These General Terms and Conditions of Membership set out the terms for joining and operation of the "KusmiKlub" loyalty program (hereinafter the "General Terms and Conditions of Membership"). Membership to the program implies full knowledge and acceptance of these General Terms and Conditions of Membership, which are only available in French and apply from 2016, April 25th.
The "KusmiKlub" loyalty program (hereinafter the "Program" or "KusmiKlub") enables its Members (hereinafter the "Member(s)") to benefit from the different advantages offered by Orientis. It applies in the KUSMI TEA stores located in France, USA, Austria and Germany (excluding in-store concessions and department stores) and to the online store, accessible at the following address www.kusmitea.com.
Conditions of membership and how to join the "KusmiKlub" loyalty program
Conditions of membership to KusmiKlub
Membership to the Program is free and takes places exclusively in the KUSMI TEA stores located in France, USA, Austria and Germany (excluding in-store concessions and department stores) and on the online store www.kusmitea.com.
A single membership per person will be taken into account. Membership is strictly personal, only the Member having joined the KusmiKlub Program can benefit from the advantages set out below. Use by any other person is prohibited and cannot be accepted in the event of presentation at the till. Only adults (aged 18 and over) with an address in France, USA, Austria and Germany can join the Program. You guarantee the accuracy of the information provided and will be solely responsible for any false, incomplete or obsolete information. Once this information is completed, your membership to the Program will be validated and you will have access to your personalised space (hereinafter the "customer account") on the KUSMI TEA site.
Since the "KusmiKlub" Program is fully electronic, no physical media will be sent to you.
Customers benefiting from partner discounts or discounts granted in a work context (including employees of the ORIENTIS group) cannot benefit from the advantages of the "KusmiKlub" Program.
How to join the "KusmiKlub" loyalty program
Following an in-store purchase, if you want to join the Program you simply need to provide your email address at the time of your purchase. You will then receive an email inviting you to fill in online the following minimum compulsory information in order to validate your membership to the Program:
- Last name
- Frist name
- Post code
You will also be invited to send the following information to KUSMI TEA, if you wish:
- Date of birth
Online store purchase
If your purchase is made online, you can join the "KusmiKlub" Program by clicking on the link that is either next to your Cart, or on the order confirmation page. You will then simply need to fill in the different fields required listed above and confirm your registration.
Registration via your online customer account
You can join the Program, outside any purchasing process. In order to do this, you simply need to connect to your member space on our KUSMI TEA site and go to the "KusmiKlub" column situated on the homepage of your account.
Acquisition of points
On each of your purchases, you accumulate points according to the following scale: 1 dollar incl. VAT = 10 points. In order to do this, if you make an in-store purchase you simply need to give your name at the till. In the event of an online purchase, the amount of your purchases will be automatically converted into points, which will be credited to your Member account. The accumulation of points begins from the first day of joining the Program. These points are valid for 1 (one) year from the date on which they have been accumulated. In the event of a product being exchanged or reimbursed, the number of points related to the purchase of this product will be deducted from the balance of your points. The points can in no case be transferred or exchanged against cash. You can freely view the number of points accumulated directly in your online customer account or on request in the KUSMI TEA store. Additional points can be acquired in the event of special transactions (birthday, special offers, etc.).
You can exchange your points against one or more gifts. According to the number of points that you have, you can choose one or more gifts from catalogue KusmiKlub available in your online customer account or viewable in-store. You can collect your gift, according to available stocks, from the KUSMI TEA stores located in France, USA, Germany and Austria (excluding in-store concessions or department stores) or add them to your order in the event of a purchase in the online store on condition that this order is delivered within France, USA, Germany and Austria. On the other hand, if you want to receive your gift outside of any online order, you pay the postage. No article other than those that are part of the catalogue can be sent to the Member. The gifts acquired under the "KusmiKlub" Program cannot be exchanged or reimbursed. Orientis Gourmet cannot be held responsible if certain products are unavailable and can at any time substitute one product for another and/or eliminate a level granting access to a gift.
In the event of a breach of the General Terms and Conditions of Membership of the "KusmiKlub" Program by the Member, Orientis Gourmet reserves the right to exclude the latter from the Program. Exclusion results in the immediate loss of all the advantages acquired in relation to the Program, without any offsetting or compensation.
Amendment and termination of the Program
Orientis Gourmet reserves the right, at any time and without notice either to amend these General Terms and Conditions of Membership or to terminate the Program. If the Program is terminated, the Member will be notified and cannot exercise any recourse whatsoever against Orientis Gourmet.
Cancelling your registration
You can cancel your registration to the Program at any time, via your customer account on the KUSMI TEA site. In this case, if your points have not been used, they will be definitively lost. You cannot claim any offsetting or compensation of any kind whatsoever.
12. Participating in Kusmi Tea “Private Sales”
Orientis Gourmet may organize private sales (referred to as “Private Sales”) on its website during which a defined list of products will be discounted.
To participate, you will need to register for the Private Sale before it begins. If you already have an account you will need to enter your email address, and if you do not have an account you will need to create one.
During the Private Sale
The discount offered during the Private Sale cannot be combined with any other promotional offers, including sales with a promo code, a gift card or voucher.
You can benefit from additional promotions by referring your friends, family and colleagues to our website. You just need to enter their email address or invite them via Facebook or Twitter. For each referral that signs up for the Private Sale, you will receive additional benefits. An email will be sent to you a few days after the Private Sale ends, which will detail which benefits you will receive.
The benefits vary according to the number of referrals you have. Accordingly, you will receive with you next online order:
- 2 referrals: 1 0.88 mini tin of your choice ($6.00 value)
- 5 referrals: 1 Kusmi Tea shopping bag ($19.00 value)
- 10 referrals: 1 8.8 oz tin of Tea of your choice among the Wellness line ($35.70 value)
Your referrals only need to register for the Private Sale in order for you to benefit from referral benefits; it is not necessary for your referrals to place an order.
